On Naver News comment sections, HYBE took direct legal action against a netizen who used expressions like "media manipulation" and "mental illness" toward the company, but the prosecution concluded with no charges. The reasoning was that it is difficult to view the term "manipulation" as false, and that rude expressions can be seen as personal opinions.
According to a non-prosecution decision obtained by Financial News on the 20th, the Incheon District Prosecutors’ Office Bucheon Branch dismissed the case against person A, who was accused of violating the Act on Promotion of Information and Communications Network Utilization and Information Protection (defamation) and insult charges, on the 4th of this month due to “lack of evidence.”
Last September, from their residence in Ontario, Canada, A posted a comment under a Naver News article titled “HYBE’s global girl group KATSEYE enters the US Billboard ‘Bubbling Under Hot 100’ chart,” saying, “Oh, and HYBE recently acquired a US media manipulation company.”
Later, under another article titled “Min Heejin, who expressed anger: ‘Lawsuit costs with HYBE total 2.3 billion won… I might have to sell my house,’” A also wrote, “HYBE seems like a group collectively suffering from mental illness; were they subjected to ‘meat juice writing’ by Bang Sihyuk? They're just like Ham*s.”
HYBE responded, claiming, “The accused falsely stated that HYBE’s acquisition of the PR agency ‘The Agency’ involved unfair media manipulation, damaging our reputation. They also insulted us by describing HYBE as a company with mental illness and compared us to the terrorist organization Ham*s.”
However, the prosecution said, “The Agency group is a PR agency that favors favorable edits for celebrities, so it is difficult to see the term ‘manipulation’ as false information.” They added, “It cannot be definitively stated that the comment implied HYBE manipulated the media in the US, and even if The Agency was called a media manipulation company, it is difficult to consider this as damaging HYBE’s social reputation,” citing insufficient evidence.
The prosecution also noted, “Although rude expressions like ‘mental illness’ and ‘Ham*s’ were used in the comments, they can be viewed as expressions of personal opinion. Considering that the matter has been reported multiple times and is of public interest, and that insults involving public figures or issues require stricter evaluation for criminal liability, it is difficult to see the comment alone as damaging HYBE’s personal social reputation.” They concluded there was no evidence to support otherwise.
