
The sentencing of Taeil (31, real name Moon Taeil), formerly of the group NCT, who was arrested on charges of quasi-r**e, will be announced.
On the afternoon of the 17th, the 11-3 Criminal Division of the Seoul High Court will hold an appeals trial for Taeil and three others on charges of violating the Act on Special Cases Concerning the Punishment of S*****l Crimes (quasi-r**e).
At the trial held on September 17th, the prosecution sought the same seven-year prison sentence for Taeil as in the first trial. They argued that "the crime was serious and the nature of the crime was heinous," and emphasized that "even if the victim agreed, a comprehensive review of the case shows that the first trial was overly lenient."
The trial court sentenced Taeil and his accomplices, Lee and Hong, to three years and six months in prison and ordered their detention, after they were indicted on charges of special quasi-r**e under the Act on the Punishment of S****l Violence. The trial court explained its reasons for sentencing, stating that it considered the defendants' first offenses, their full admission of the crimes, and the fact that they reached an agreement with the victim, who did not wish to be punished, as favorable circumstances in its sentencing.
Taeil's defense attorney stated, "(Taeil) turned himself in to the investigative authorities to reflect on his actions and has actively cooperated with the investigation. The victim has also expressed her desire not to have him punished." They continued, "We accept the seriousness of this incident, but please carefully examine the circumstances of the crime. After drinking with the victim and making physical contact, he went to her residence and committed the crime. He did not plan the crime; he simply wanted to drink more."
Taeil and two others were indicted without detention this March on charges of SA an intoxicated foreign woman along with two acquaintances in June of last year. The charge of aggravated quasi-r**e applies when the perpetrator possesses a weapon or when two or more individuals jointly engage in intercourse with a victim who is mentally or physically incapacitated and unable to resist.
According to the investigation, around 2:33 a.m. on the day of the crime, the suspects met the victim, a foreign tourist referred to as Ms. A, at a club in Itaewon, Yongsan-gu, Seoul. While drinking together, and after Ms. A became heavily intoxicated, they put her in a taxi and took her to the residence of one of the accomplices, Lee, where the as***lt took place.
It was also found that after the crime, the suspects discussed intentionally sending the victim off in a taxi from a location different from where the as***lt occurred.

Furthermore, the prosecution stated: "The incident occurred on June 13. For two months, the police tracked the defendants, analyzing CCTV footage, and only after two months were they able to conduct a search and seizure. It was only after that point that the defendant submitted a written statement claiming it was a voluntary surrender. Given that, we believe the continued claim of ‘turning himself in’ is highly inappropriate. Not only does it fail to meet the legal requirements for a voluntary surrender, but it also significantly undermines the very meaning of what it means to turn oneself in."
