"This is W Korea.

The breast cancer awareness campaign “Love Your W” is a campaign that began in 2006 and has striven for the past 20 years to increase awareness of the importance of early breast cancer screenings.
However, the event on October 15 sparked criticism that its format and execution were inappropriate in light of the objective of the campaign, and we are taking this criticism seriously.

Above all else, we would like to deeply apologize for having caused discomfort and pain by failing to carefully consider the perspective of breast cancer patients and their families.

Additionally, we feel deeply apologetic when we think of how this controversy must have inconvenienced the many people who participated in our event with good intentions because they empathized with the campaign’s purpose.

We are reflecting on our shortcomings while thinking of all the people who were hurt by this event.

Over the years, at the heart of this campaign has been the activities of the Korea Breast Cancer Foundation, which raises awareness of the importance of early breast cancer detection and helps cover surgical costs for patients in need of financial assistance, along with the support of the people who have shown warmhearted interest in supporting [the foundation’s] activities.
In order to ensure that their heartfelt sincerity shines through, we will continue to examine our shortcomings based on the various criticisms and rebukes we have received. We will take this incident as an opportunity to more carefully reexamine the entire process of event planning and execution.

[theqoo] DESPITE W KOREA'S APOLOGY, PUBLIC OPINION IS DEMANDING 'THE LAW TO BE APPLIED' AS CONTROVERSY OVER ALLEGED VIOLATION OF THE DONATION ACT ESCALATES


‘Not only should an investigation into potential illegality proceed, but a tax audit must follow.’

Although an apology statement was issued four days after the controversy erupted, albeit belatedly, public outrage shows no sign of abating. Demands are mounting for a thorough investigation into potential violations of the Donations Act and other laws surrounding the controversial breast cancer donation campaign, along with a rigorous tax audit.      

 This situation was triggered when singer Park Jaebeom performed his song “Body”, explicitly depicting female bodies and restricted to listeners aged 19 and over, at the event. It has since escalated into questions about the transparency of donation management. These transparency concerns, which undermine the event's original purpose, were further fuelled when Lee Soo-jin, a Democratic Party of Korea member of the National Assembly's Health and Welfare Committee, disclosed data submitted by the Ministry of Health and Welfare. According to the data from Rep. Lee's office, the scale of donations by W Korea was significantly lower than previously known.  

W Korea issued an official apology on the 19th and shared a detailed breakdown of donations in PDF format with some media outlets, but this appears insufficient to quell the intense public backlash. Instead, a significant number of netizens have taken to various online communities demanding investigations into the legality of the donation campaign, including calls for rigorous tax audits.

Legal circles are citing the “Act on Solicitation and Use of Donations and Promotion of Donation Culture”, commonly known as the Donation Act, as the benchmark for determining the legality of the campaign. Reviewing the legislation reveals that fundraising exceeding 10 million won requires registration with either the Minister of the Interior and Safety (for annual amounts exceeding 1 billion won) or the relevant metropolitan or provincial governor (for lesser sums). Furthermore, when the amount raised exceeds 100 million won, there is an obligation to prepare an audit report via a certified public accountant and publish this online.

Violations of the law carry penalties of up to three years' imprisonment or a fine not exceeding 30 million won. The bill explicitly states that illegal activities include collecting funds without registration, making false registrations, using collected funds for purposes other than those stated, failing to submit reports, and violating disclosure obligations.

Tax investigations are a separate matter. Funds raised without following the procedures of the Donations Act may be considered income and thus subject to taxation, with the issue of whether they were properly declared becoming a point of contention.

Some legal circles anticipate that if the funds raised were not used for the promised purpose, it could potentially constitute fraud or embezzlement under civil law.
