Prosecutors have again requested a prison sentence in the appeals trial of the operator of the YouTube channel Sojang, who made billions of won in profits from videos defaming celebrities such as IVE member Jang Wonyoung.

On the 16th, the Incheon District Court Criminal Appeals Division 1-3 (Chief Judge Jang Min-seok) held the first hearing and sentencing proceeding of the appeal trial for A (age 37), who was indicted on charges including defamation under the Act on Promotion of Information and Communications Network Utilization and Information Protection.

In the first trial, A was sentenced to 2 years in prison, suspended for 3 years, along with 120 hours of community service and a forfeiture of over 200 million won (~150K USD). Both A and the prosecution appealed. A claiming the sentence was too heavy, and the prosecution arguing it was too light.

During the appeal trial, the prosecution again requested a sentence of 4 years in prison, the same as in the first trial.

During final arguments, A’s defense stated, “The defendant has deeply realized the pain the victims must have felt and the severity of the incident through public criticism and media scrutiny. Although the victims did not wish to settle, he made a court deposit before the first ruling and voluntarily deleted the YouTube channel. Considering these factors, the original sentence was not too lenient.”

In his final statement, A said, “I created the videos by compiling online posts and comments, believing I was fulfilling the public’s right to know. But now I clearly understand how serious a mistake that was.”

He continued, “Since the incident, my personal information has been exposed, and I’ve been living under public stigma. I’m receiving psychiatric treatment and trying to get by each day. I deeply reflect on my wrongdoing and ask for one last chance to live as a proper member of society.”

The sentencing for the appeal trial is scheduled to take place on November 11 in the same courtroom.
