In the lawsuit between HYBE and former ADOR CEO Min Heejin over the termination of their shareholder agreement and a put-option dispute, a “non-indictment decision” related to Min’s alleged breach of trust emerged as an unexpected issue.
At the hearing held on the 18th at the Seoul Central District Court (Civil Division 31), HYBE asked Min, “You appeared on the YouTube program Genre Man Yeouido and explained your position for over an hour. During that broadcast, did you say that the non-indictment decision written by the police after their investigation was over 200 pages long?”
Min replied, “Yes, the non-indictment decision I received.”
HYBE then questioned this, saying, “The non-indictment decision submitted to the court by the defendant is 19 pages. But you said on the broadcast it was over 200 pages...” expressing doubt.
Typically, a non-indictment decision is not anywhere near 200 pages long. The presiding judge also asked, “Did you really say on the broadcast that it was 200 pages?” Min answered, “Yes, because what I received was over 200 pages.”
HYBE followed up, saying, “What the defendant’s counsel submitted is 19 pages, yet you keep saying you received over 200 pages, that investigators reviewed all the evidence you submitted and reached a conclusion in your favor.” The judge again asked, “Did you actually receive an investigation document of over 200 pages from the investigative authorities?” Min responded, “Yes, yes.”
HYBE’s line of questioning appears to stem from the likelihood that the document in question was not a non-indictment decision, but rather an investigation report detailing the investigative process. Generally, police non-indictment decisions are about 10 pages long and never reach 200 pages.
In fact, several YouTube channels and online communities have consistently pointed out that the document format Min’s side disclosed appears to be an investigation result report containing investigators’ assessments, rather than a standard non-indictment decision. This is also believed to be why the judge repeatedly sought clarification.
While Min acknowledged without much concern that she personally received a document exceeding 200 pages, her legal representatives from Shin & Kim (Sejong) reacted very sensitively and intervened immediately.
When the judge asked, “Did you submit that 200-plus-page non-indictment decision as evidence?” Sejong responded firmly, “We did not submit it as evidence. Presenting evidence is our responsibility. We have already submitted the necessary non-indictment decision.”
The judge then said, “If there’s a dispute over whether it’s 200 pages or 19 pages, you could at least submit the page count,” to which the Sejong attorney replied vaguely, “That’s something we would need to review...”
According to legal experts, if an investigation report totaling around 200 pages was actually delivered to the party involved in the case, it would be a serious issue.
Former prosecutor and attorney Min Kyung-cheol said on his YouTube channel Law GPT that “the non-indictment decision Min Hee-jin claims cannot possibly be 200 pages,” adding, “The document shown on YouTube is an internal investigative document that records the investigation process, something ordinary citizens are not allowed to see.”
He further stated, “If an internal approval-line investigation report was leaked to a party involved in the case, it would be a serious criminal act undermining the fairness of the investigation, constituting a violation of official secrecy, which carries criminal penalties without the option of a fine.”
