
"The plaintiff admits that, in promoting ILLIT, they used NewJeans as a reference by running billboard ads similar to NewJeans’. Before ILLIT’s debut, they showed images of NewJeans’ billboard advertisements and conveyed to ILLIT’s billboard director that they wanted something similar."

"“The plaintiff keeps changing their claims. They said that ILLIT’s final concept was confirmed on July 21, 2023, but the so-called ‘July proposal’ has still never been submitted as evidence. We cannot even verify whether it actually exists.”
They also stated that the “July proposal” is “completely different” in both template and content from ILLIT’s “September proposal,” which had been criticized for plagiarism.
As further grounds, they cited an internal employee’s report claiming that NewJeans’ planning proposal was referenced when drafting ILLIT’s proposal, as well as a report from an employee of a HYBE affiliate stating that reference videos were shown and that choreography would not be selected unless it produced movements similar to those references."
A request was made to make ILLIT’s billboard advertisement similar to NewJeans’ billboard ad images (both were for debut promotions).
A whistleblower recording in which an employee who had shared NewJeans’ project proposal with Belift Lab stated that they “didn’t expect it to be made exactly like this (ILLIT’s proposal).”
Reference videos were shown, and choreography would not be selected unless similar movements appeared.
The court acknowledged that the planning proposal was indeed reviewed, and therefore it cannot be ruled out that NewJeans’ proposal was reflected. It was stated that NewJeans’ concept appears to have been similarly reflected in ILLIT, and that failing to seek prior consent or consultation was also problematic.
