Global luxury brand Chanel has warned that it will file a trademark infringement lawsuit against Coco de Mer, a small-to-medium-sized Korean cosmetics company. Analysts suggest that as exports by “K-Beauty” companies increase, global corporations are taking steps to curb their growth.
According to the cosmetics industry on the 30th, Coco de Mer received a warning letter earlier this month from Banning, a Dutch-based global law firm representing Chanel, regarding trademark infringement. Chanel took issue with two trademarks that Cocodemer had filed with a local distributor in the Netherlands.
Chanel argued, “Chanel holds the rights to the international trademark ‘COCO’ in the Benelux region,” adding, “The ‘COCO’ included in Cocodemer is visually and conceptually identical to Chanel’s ‘COCO.’” The company also stated, “We may file an opposition to the trademark application and pursue legal action.”
In response, Kim Yoo-min, CEO of Coco de Mer, said, “We have already completed trademark registration not only in Korea but also in the U.S., Japan, and Taiwan, yet Chanel has raised an objection belatedly,” adding, “We have even produced promotional videos for local marketing, but due to this dispute, we are unable to ship our products.”
CEO Kim argued, “Coco de Mer is a proper noun referring to the giant coconut (Coco de Mer) from the Seychelles in the Indian Ocean,” and claimed, “It has no connection to the Chanel brand.”
Coco de Mer is a domestic small-to-medium-sized enterprise that manufactures basic cosmetics such as bubble packs, mists, and nourishing creams. Concerns are emerging within the cosmetics industry that global companies may file a series of lawsuits against domestic cosmetics firms. Previously, in 2023, Chanel was involved in a trademark dispute with Coco Dor, a domestic air freshener manufacturer, but lost the case. Legal experts believe that if similar lawsuits are filed overseas, the rulings may favor Chanel.
