We would like to inform you of the results of our legal action against the YouTube channel 'Sojang' for producing and distributing videos containing false information with the intent of defamation related to our affiliated artists.
In April 2024, our company filed a criminal complaint against the operator of the channel on charges of defamation and insult under the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc., in relation to EXO, Red Velvet, and aespa. Subsequently, in October of the same year, we filed a civil lawsuit against the same individual as the defendant.
On January 15, 2025, the Incheon District Court determined that the channel operator had seriously infringed upon the honor and personality rights of our artists by disseminating false information and producing and posting videos containing personal attacks or contemptuous expressions, thereby publicly insulting them. The court viewed these acts as crimes that significantly deviated from the scope of mere expression of opinion, sentencing the channel operator to two years' imprisonment with three years' suspended execution, 120 hours of community service, and a confiscation of approximately 211.42 million won. The operator appealed and further appealed this decision but ultimately, the original ruling was finalized.
Additionally, on April 22 of this year, the 14th Civil Division of the Seoul Central District Court ruled that the 'Sojang' channel operator had infringed upon the personality rights of our artists by producing and posting videos containing personally attacking expressions targeting them, ordering the operator to pay a total of 130 million won in damages to our artists. In addition, recognizing that 'the videos produced and posted by the channel operator led to a decline in the image and brand value of SM-affiliated artists, who are SM's core assets, thereby causing substantial hindrance to SM's business operations and performance of duties,' the court also ordered 40 million won in damages to our company. As a result, a judgment was issued requiring the 'Sojang' channel operator to pay a total of 170 million won in compensation (115K USD).
Our company will continue to take strong legal action without tolerance against YouTube channels that engage in personal attacks, use of insulting or contemptuous expressions, and dissemination of false information targeting our affiliated artists, in order to protect them. We ask that you immediately cease all ongoing illegal acts against our artists.
