Following their appeal against the court’s ruling prohibiting independent activities, the five members of girl group NewJeans, currently in a legal dispute with their agency ADOR, have brought in high-profile former judges and legal officials to their legal team. With NewJeans suspending all activities after their injunction objection was dismissed, both sides have now enlisted major law firms and heavyweight legal figures, raising expectations for what is being called a “battle of the century.”
According to the legal community on the 21st, the appeal related to NewJeans’ objection to the injunction has been assigned to the 25th Civil Division of the Seoul High Court (Presiding Judges Hwang Byung-ha, Jung Jong-gwan, and Lee Kyun-yong).
For the appeal, NewJeans has added Park Hyung-nam (65), managing attorney at Law Firm Wooseung, to their existing legal team from Shin & Kim (Sejong). Park previously served as the head of the Judicial Policy Research Institute.
Park is a top legal talent, having passed both the bar and civil service exams while in his fourth year at Seoul National University’s law school. He went on to become a judge at the Seoul District Court and held positions such as Director of Litigation Affairs at the National Court Administration and Chief Judge of the Jeonju District Court. In 2008, he became a Senior Judge at the Seoul High Court and in 2023, was appointed as the 5th head of the Judicial Policy Research Institute, a first for an active judge, before retiring honorably in February and joining Law Firm Wooseung. With Park’s addition and Shin & Kim partner attorney Lee Won (55), NewJeans’ legal team has grown to 14 members.
ADOR, on the other hand, has added former Constitutional Court Judge Kang Il-won (66) and Chun Ji-sung (47), known as the daughter of former Justice Minister Chun Jung-bae, to their team, in addition to representation from Kim & Chang, Korea’s largest law firm. Earlier, on May 12, they also added Hong Seung-myeon (60), a former senior judge at the High Court. ADOR now has 13 lawyers representing them.
With these heavyweight former legal officials joining the fray, there is growing speculation within the legal community about whether the case could take a new turn.
The five NewJeans members declared their exclusive contracts with ADOR void in November last year, claiming violations by the agency, and began independent activities. ADOR responded by asserting the contracts were still valid and filed a lawsuit to confirm the validity of the exclusive contracts, along with a request for an injunction to block the members’ independent activities.
On March 21, Civil Division 50 of the Seoul Central District Court (Presiding Judge Kim Sang-hoon) ruled in favor of ADOR, granting the agency’s request to prohibit NewJeans from signing advertising contracts and maintaining their status as the managing agency.
The court stated, “It is difficult to conclude that there is sufficient evidence proving that ADOR violated key terms of the exclusive contract or that the trust between the two parties had been irrevocably broken,” siding with the agency.
Though the members of NewJeans filed an objection to the injunction, the court maintained its original decision, calling the injunction “legitimate.” In response, the members immediately filed an appeal. As of now, NewJeans has suspended all activities.
