On this day, Source Music attempted to explain the situation through a 20-minute presentation, but Min Heejin's side argued that the KakaoTalk messages used as evidence were illegally obtained and should not be admitted.
When Min Heejin's side requested that the KakaoTalk content not be made public, the court responded, “If the material was obtained by violating communication privacy laws, it would be difficult to admit it. The content will be made public, but any parts the defendant raises issues with will have limited citations. However, we cannot prevent parties from making claims.” The court added, “During this hearing, we will restrict arguments concerning claims that the evidence was acquired through illegal means between individuals.”
In response, Source Music stated, “This evidence is not being revealed for the first time. There is no Supreme Court ruling declaring such evidence inadmissible in civil trials. It is questionable whether it is appropriate to raise such issues right before the trial. The materials were collected with prior consent and are different from data obtained by secretly taking someone’s phone.” They continued, “We understand the doubts about whether it can be used as evidence. But shouldn’t we resolve the debate and clarify whether it can or cannot be used?”
As Source Music, who had prepared a presentation, raised objections, the court decided to reconvene the trial on June 27 after hearing both sides’ positions.
Previously, former CEO Min Heejin claimed in press conferences and statements that “she personally cast the NewJeans members,” “HYBE unilaterally broke its promise to debut NewJeans as its first girl group,” and “Source Music neglected the NewJeans members.”
In response, Source Music stated, “Min Heejin’s claims are false,” and added, “Due to her remarks, LE SSERAFIM has been wrongly labeled as a group that received preferential treatment at the expense of others, resulting in severe online har***ment and reputational damage.”
