[theqoo] STRAY KIDS' LEE YONGBOK TO RECEIVE THE IDENTIY OF THE PERSON WHO DEFAMED HIM ON SOCIAL MEDIA WITH ACCUSATIONS OF 'POWER TRIP"

Felix (real name Lee Yongbok), a member of the K-pop group Stray Kids, is taking legal action against a social media user who repeatedly posted defamatory and false statements about him on SNS. The legal move comes as part of a discovery process initiated in the United States against X.

On September 5, the US District Court for the Northern District of California granted a discovery request allowing Lee to obtain personally identifiable information (PII) from X. The presiding judge, Beth Labson Freeman, approved the petition under 28 U.S.C. § 1782, a US federal statute that permits discovery in aid of foreign legal proceedings.

According to court documents, Lee stated that an anonymous X user posted false and defamatory content targeting him on March 8, March 15, and May 24. The posts alleged that he "treated staff like servants" and "acted like a prince", which he claims caused him mental distress, physical stress, and damage to his reputation as an artist.

Previously, Lee filed a civil defamation suit with the Seoul Eastern District Court in Korea, but the case could not proceed because the perpetrator’s real name and address were unknown, preventing proper delivery of legal documents.

As a result, Lee sought court approval in the U.S. to issue a subpoena compelling X to provide the PII needed to identify the anonymous user. The court approved his request, noting that the subpoena was narrowly tailored to identify the individual and facilitate the legal case in Korea. The judge also cited precedent for similar cases handled within California courts.



Judge Freeman determined that the three legal requirements had been met and that the four Intel factors also weighed in favor of the petitioner. The judge accepted the petitioner’s argument that X is not a party to the Korean lawsuit, and thus not subject to the Korean court's jurisdiction, and also acknowledged that Korean civil courts are generally receptive to assistance from US federal courts.

In her final order, the court granted limited discovery and approved service of a document production request to X, which is substantially identical to the draft subpoena submitted by the petitioner.

Lee’s Korean legal representative, Jung Kyung-seok, managing attorney at Law Firm Ryu, stated in a declaration that under Articles 750 and 751 of the Korean Civil Code, the elements for a defamation and insult-based damages claim are satisfied, and that the evidence presented is prima facie sufficient to survive dismissal in the main case.

He explained that the key issue is identifying the defendant, and that a combination of personally identifiable information (PII) such as name and date of birth, along with supplementary data like phone number, bank account information, and recent login records (login timestamps and IP addresses) would be required. This data would allow authorities, via telecom providers or local governments, to trace and confirm the real name and address of the individual.

Jung emphasized that login records are typically stored by platforms for only 3 to 6 months, making access to recent logs critical.

Based on Lee’s account of harm and Jung’s declaration, the U.S. court resolved the case in just three days after it was filed on September 2.
