On the afternoon of November 7, the 12th Civil Division of the Seoul Western District Court held the fourth hearing for SOURCE MUSIC’s 500 million won (~$360,000 USD) damages lawsuit against former ADOR CEO Min Heejin. SOURCE MUSIC filed the suit in July 2024 through the same court.
At the hearing, both sides’ legal representatives appeared and proceeded with arguments. SOURCE MUSIC rebutted all of Min Heejin’s claims from her previous press conference, including “I cast the NewJeans members myself” and “HYBE broke its promise to let me debut HYBE’s first girl group.”
SOURCE MUSIC submitted trainee contract videos as evidence to prove the selection process of the NewJeans members. The plaintiff’s side stated, “It was the plaintiff who cast the NewJeans members, and there was never any promise that they would be HYBE’s first girl group. Minji was cast by the plaintiff, and Hyein was street-cast in Anyang. Hyein’s mother even commented that it was amazing they met there.”
They continued, “For Hyein, we personally persuaded her parents to allow her to train, Danielle joined when her manager moved to SOURCE MUSIC, and Hanni cannot be said to have been recruited by the defendant since Min’s international reputation was minimal at the time. The NewJeans members did not join under the belief they would debut as HYBE’s first girl group. In Danielle’s trainee video, she says, ‘If I don’t make the final lineup, please give me the option to transfer or stay.’ Hyein’s trainee video also supports this.”
Regarding Min’s claim that “HYBE broke its promise to debut NewJeans as the company’s first girl group,” SOURCE MUSIC cited her own words in response. On July 8, 2021, Min Hee-jin wrote on the internal Slack messenger to then-CEO Park Ji-won: “I don’t care when LE SSERAFIM debuts. I just want NewJeans to transfer to the M (Min Heejin) label and become the first team under M Label.”
Additionally, in a conversation with a shaman on August 12, 2021, Min said, “I wanted to go last too. The main character comes last,” expressing her wish for NewJeans to debut after LE SSERAFIM. SOURCE MUSIC argued, “There was no promise to debut NewJeans first, yet she publicly made false claims that damaged our reputation.”
SOURCE MUSIC also refuted Min’s remark that the company “sold trainees like thugs,” saying, “Discovering and debuting talent is impossible without image and trust. Min Heejin’s statements shook the company’s business foundation and caused severe harm to its employees and artists.”
They continued, “Min Heejin claims that the word ‘thug’ is not damaging to one’s reputation, yet she herself filed for damages against netizens who called her a thug, a blatantly contradictory stance. We ask the court to order her to pay damages equivalent to her responsibility.”
During the second hearing in May, SOURCE MUSIC had submitted a 20-minute PowerPoint containing Min’s internal messenger conversations, but Min’s side argued that the data had been collected illegally without consent. However, at the third hearing in August, the court ruled, “Considering the access route and internal consent to the KakaoTalk account, it cannot be deemed illegal evidence,” and accepted Min’s messenger contents as valid evidence.
In a related case, during the first trial on the validity of the exclusive contract between NewJeans and ADOR, the court had also recognized KakaoTalk messages involving Min’s whistleblowing within HYBE, ruling in favor of ADOR.
Min Heejin had previously claimed through press conferences that “she personally cast the NewJeans members,” that “HYBE broke its promise to debut them as its first girl group,” and that “SOURCE MUSIC neglected the NewJeans trainees.”
In response, SOURCE MUSIC stated, “Min Heejin’s claims are false. Her statements led to rumors that LE SSERAFIM received favoritism at the expense of other teams, which caused the members to suffer from severe online harassment.” Consequently, SOURCE MUSIC filed the 500 million won lawsuit against Min in July 2024 for defamation, obstruction of business, and insult. BELIFT LAB also filed a separate 2 billion (~$1.44 million USD) damages suit against her.
