[Nate] PROSECUTION INVESTIGATOR WHO LEAKED INVESTIGATION DETAILS ON THE LATE LEE SUNKYUNG RECEIVES SUSPENDED PRISON SENTENCE



A prosecution investigator from the Incheon District Prosecutors' Office has received a suspended prison sentence for leaking confidential information to the media during an investigation into alleged drug use.



On the 18th, Judge Gong Woo-jin of the Incheon District Court (Criminal Division 14) sentenced an investigator from the Incheon District Prosecutors' Office, identified as A, to one year in prison suspended for two years; A had been indicted without detention on charges including the disclosure of official secrets. The court ruled, "If information regarding individuals involved in an investigation is leaked, a suspect could destroy evidence, or significant obstacles could arise in the investigative agency's evidence-gathering process." The court further stated, "As an investigator at the Incheon District Prosecutors' Office, A obtained investigative information that constituted an official secret related to the investigation; therefore, the charges are upheld."


During the trial, Person A denied the charges, claiming that the information had already spread within the prosecution and that they had simply learned of it through other staff members; however, the court rejected this argument. The court noted that by leaking various investigative secrets to a reporter, the defendant had seriously undermined public trust in the law enforcement activities of a state agency. The court further pointed out that the defendant’s post-offense conduct, such as replacing their mobile phone during the investigation to conceal evidence, was highly improper. Nevertheless, the court took into account mitigating factors, including the absence of any financial gain, the defendant's status as a first-time offender, and their 12-year career as a prosecution investigator, during which they had received commendations without any record of disciplinary action.


Individual A was indicted on charges of twice leaking information, specifically, the fact that the late actor Lee Sun-kyun was under internal police investigation for alleged drug use and details regarding the investigation's progress, to Reporter B at a daily newspaper in the Gyeonggi region. The media outlet published an exclusive report on the "internal investigation of top star L" on October 19 of that year. After undergoing police questioning on three occasions, Lee Sun-kyun was found dead in his vehicle on December 27, 2023.

Other cases involving similar charges are also proceeding through the courts. A former police officer indicted for leaking information about the Lee Sun-kyun investigation was sentenced to one year and two months in prison, suspended for two years, in the first trial; an appellate trial is currently underway following an appeal by the prosecution.
