What happens if intent is proven?

If the National Tax Service determines Cha Eunwoo's actions constituted intentional tax evasion, the case will proceed to prosecution for violation of the Tax Crime Punishment Act. The legal provisions applied at this stage far exceed the standard penalties under the Tax Crime Punishment Act.

In Cha Eunwoo's case, the evaded tax amount is estimated to be in the tens of billions of won, potentially reaching up to 10 billion won. If the annual evaded tax exceeds 1 billion won, the Act on the Aggravated Punishment of Specific Crimes (Special Act) applies.

Article 8 of the Special Act stipulates that evasion exceeding 1 billion won is punishable by life imprisonment or a minimum of five years' imprisonment. Unlike the general Tax Crime Punishment Act (capping sentences at three years), the five-year minimum sentence means a suspended sentence is highly unlikely in principle, making a prison term very probable.

Even more daunting is the fine. The Special Act mandates a fine of at least twice and up to five times the evaded tax amount, imposed separately from the prison sentence. If the evaded tax is confirmed at 10 billion won, Cha Eunwoo could face a prison sentence alongside a fine ranging from a minimum of 2 billion won to a maximum of 5 billion won.

Currently, his agency maintains that the matter is not yet finalized and that they will present their case according to legal procedures.
